THE COMPANY DOES NOT WARRANT THAT THE WEBSITE WILL OPERATE WITHOUT INTERRUPTION, ERROR, SECURITY BREACH, OR DEFECT. 

 Limitation of Liability

IN NO EVENT SHALL THE COMPANY’S AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT PAID BY THE USER TO THE COMPANY DURING THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER. 

Indemnification

Arbitration and Class Action Waiver 

Any dispute arising from or relating to these Terms, the Website, or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. 

The arbitration shall take place in Kent County, Michigan. 

You and Reaching Xanadu agree that all claims shall be brought solely in an individual capacity and not as a plaintiff, class representative, or class member in any purported class, collective, consolidated, representative, or mass action. 

Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan without regard to conflict of law principles. 

Changes to Terms 

Reaching Xanadu reserves the right to modify these Terms at any time. Updated versions will be posted on the Website with a revised Effective Date. Continued use of the Website following any modifications constitutes acceptance of the revised Terms.
